1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of services provided by A1 Property Handler LLP (operating as "Servefar"), a limited liability partnership registered in India.

By engaging our services, accessing our website, or signing a Service Agreement with us, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Definitions

  • "We," "Us," "Our" refers to A1 Property Handler LLP operating as Servefar
  • "Client," "You," "Your" refers to the individual or entity engaging our services
  • "Property" refers to the real estate asset(s) under our management or advisory
  • "Services" refers to property management, tenant management, legal support, and related services as outlined in the Service Agreement
  • "Service Agreement" refers to the specific contract between Servefar and the Client detailing scope, fees, and obligations

3. Services Offered

Servefar provides the following categories of services:

  • Property Management
  • Tenant Placement and Management
  • Rental Collection and Financial Management
  • Property Maintenance and Inspections
  • Legal Documentation and Support
  • Plot Monitoring
  • Property Advisory and Valuation
  • Government Liaison and Compliance
  • Other specialized services as detailed in individual Service Agreements

The specific services, scope, deliverables, fees, and timelines will be detailed in individual Service Agreements signed between Servefar and the Client.

4. Client Obligations

As a Client, you agree to:

  • Provide accurate and complete information about your property
  • Provide necessary legal documentation (sale deeds, property records, identification, etc.)
  • Execute Power of Attorney (if required for specific services)
  • Pay agreed fees and charges in a timely manner
  • Respond promptly to communications requiring your approval or decision
  • Inform us immediately of any changes to property ownership, legal status, or contact information
  • Comply with all applicable Indian laws and regulations regarding property ownership

5. Fees and Payment

5.1 Service Fees

Fees for services will be detailed in the individual Service Agreement. Fees may be structured as:

  • One-time onboarding fees
  • Quarterly management fees
  • Percentage of rental income
  • Transaction-based fees
  • Annual maintenance contracts

5.2 Payment Terms

Unless otherwise specified, fees are due within 7 days of invoice issuance. Late payments may incur penalties as outlined in the Service Agreement.

5.3 Expenses

The Client is responsible for reimbursing reasonable expenses incurred in providing services, including but not limited to:

  • Government fees (registration, mutation, etc.)
  • Legal fees for documentation
  • Property maintenance and repair costs
  • Vendor and contractor payments
  • Travel expenses for property inspections (if outside standard service area)

All reimbursable expenses will be documented with receipts and invoices.

6. Scope and Limitations

6.1 Best Efforts

We will provide services with reasonable skill and care, using our best efforts to protect and manage your property. However, we cannot guarantee specific outcomes such as:

  • Complete prevention of plot issues (though we take immediate action)
  • Guaranteed tenant occupancy at all times
  • Specific rental rates or property appreciation
  • Favorable outcomes in legal disputes

6.2 Third-Party Services

We may engage third-party vendors (contractors, lawyers, government liaisons) to provide certain services. While we exercise due diligence in selecting vendors, we are not liable for their acts or omissions beyond our reasonable control.

7. Liability and Indemnification

7.1 Limitation of Liability

To the maximum extent permitted by law, Servefar's total liability for any claims arising from our services shall not exceed the total fees paid by the Client in the 12 months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, property depreciation, or emotional distress.

7.2 Client Indemnification

You agree to indemnify and hold Servefar harmless from any claims, damages, or expenses arising from:

  • Inaccurate or incomplete information provided by you
  • Your violation of laws or regulations
  • Disputes related to property ownership or legal title
  • Acts or omissions of your family members, tenants, or third parties not under our control

8. Confidentiality

Both parties agree to maintain confidentiality of proprietary information, personal data, financial records, and property details. This obligation continues even after termination of services.

Exceptions include disclosure required by law, court order, or government authority.

9. Term and Termination

9.1 Service Period

The service period will be specified in the Service Agreement (e.g., Quarterly, annual, or project-based).

9.2 Termination by Client

You may terminate services by providing 30 days' written notice. You are responsible for fees and expenses incurred up to the termination date.

9.3 Termination by Servefar

We may terminate services immediately if:

  • You fail to pay fees after written notice
  • You provide false or misleading information
  • You engage in illegal activities related to the property
  • Continuation of services becomes legally or practically impossible

9.4 Post-Termination

Upon termination, we will provide all property documents, financial records, and keys in our possession. Any outstanding fees must be settled before final handover.

10. Dispute Resolution

10.1 Negotiation

In the event of any dispute, both parties agree to first attempt resolution through good faith negotiation.

10.2 Arbitration

If negotiation fails, disputes shall be resolved through binding arbitration in Hyderabad, India, under the Arbitration and Conciliation Act, 1996.

10.3 Jurisdiction

These Terms are governed by the laws of India. The courts of Hyderabad, Telangana shall have exclusive jurisdiction for any legal proceedings.

11. Intellectual Property

All content on our website, including text, graphics, logos, and design, is the property of Servefar and protected by copyright laws. You may not reproduce, distribute, or use our content without written permission.

12. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, government actions, pandemics, riots, or infrastructure failures.

13. Amendments

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised "Last Updated" date. Continued use of our services constitutes acceptance of amended Terms.

Changes to individual Service Agreements require written consent from both parties.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the individual Service Agreement, constitute the entire agreement between you and Servefar, superseding all prior communications and agreements.
